Why appoint a representative
One EU contact for the life of your design
The EUIPO corresponds only with a representative established in the EU or EEA. That matters for the examination of a design application, for later proceedings such as an invalidity action or a transfer, and for renewal deadlines. A non-EEA holder can file a registered EU design directly, but cannot act alone once any of these steps arise.
Applicants without a domicile, principal place of business or establishment in the EEA must appoint a representative under Article 115(2) EUDR. Who qualifies to act as that representative is set out in Article 116 EUDR: a legal practitioner qualified in an EEA Member State, a professional representative on the EUIPO's list, an employee of a legal person with economic connections to the applicant, or an association of at least two such qualified persons.

No. Anyone can file a registered EU design application without a representative. The requirement applies to everything after filing: the Office's examination, later proceedings such as an invalidity action or a transfer, and renewals. A holder without an establishment in the EEA must be represented for those and cannot act alone.

Yes. The flat fee covers the representative appointment for the application as filed, regardless of how many individual designs it contains.
Yes. Neither the UK nor Switzerland belongs to the EEA, so applicants based there are subject to the same representation requirement as applicants in the US, Canada, Australia or any other non-EEA country.
The EUIPO examines the formal requirements of a design application and raises this when no representative meeting Article 116 EUDR has been appointed, as required by Article 115(2) EUDR for applicants without a domicile or establishment in the EEA. The application itself is not refused yet. Filing the notice of representation with a qualifying representative before the deadline is exactly what remedies this deficiency, and it is included in the flat fee.
