Why an EU trademark at EUIPO?

An EU trademark offers significant advantages over a German national trademark – not only through the considerably faster procedure, but also through the lower hurdles in the examination by the trademark and patent office.

Once registered, protection applies from the filing date. This means: anyone who files too late can no longer claim priority – even if they have been using the mark for longer.

Not only for businesses with customers, partners or distribution structures in multiple EU countries is the EU trademark almost always the first choice. Even if business activities are confined to Germany, an EU trademark can offer significant advantages due to the application process.

I've been using my trademark for years. Do I still need to register it?

Investing in advertising strengthens your brand. Trademark registration serves primarily to protect that investment. A registered trademark gives its owner the ability to take legal action against infringers and defend the mark – by filing oppositions against later trademark applications at the competent office, or by pursuing infringers directly through civil proceedings. Without registration, the options for acting against third parties are significantly limited. Moreover, failing to register a mark can result in a third party occupying the name and prohibiting its further use.

What does the trademark registration procedure look like?

Using the fast-track procedure, we typically achieve examination and filing of the trademark within a few days or weeks. After publication of the trademark application in the register, holders of earlier marks have three months to file an opposition. If no opposition is filed, the office registers the trademark. We accompany you from the first search to the certificate of registration.

Why do you recommend EUIPO filing as your core service? expand_more
The EU trademark protects you in all 27 EU member states with a single application and official fee. Compared to parallel national filings, it is significantly more cost-effective and administratively simpler. For businesses with customers or partners in multiple EU countries it is almost always the first choice.
What is the difference between Basic and Search & Filing? expand_more
The Basic package includes an identity search – meaning we check whether an identical mark is already registered. Search & Filing additionally includes a comprehensive similarity search across national and European registers as well as a legal assessment of your registration prospects. Many trademark conflicts arise from similarity, not identity – we therefore generally recommend the second package.
When is Full Protection advisable? expand_more
Full Protection is recommended when your mark contains descriptive or weak elements, meaning there is an elevated risk that the EUIPO examiner objects to the application on grounds of lack of distinctiveness or descriptiveness. With this package we are already prepared for a response at the time of engagement and can react without additional cost.
How long does a EUIPO application take? expand_more
In straightforward cases, filing an EU trademark takes just a few days. Registration follows once the three-month opposition period has expired. Your application is submitted promptly to the trademark and patent office once all documents have been agreed.
Are the official fees included in the prices? expand_more
No. The prices shown are the attorney's fee. Official fees are invoiced separately and passed directly to the relevant office. EUIPO charges €850 for the first class, €50 for the second class and €150 for each additional class. Official fees are of course shown on the invoice.
Can a non-German company file an EU trademark? expand_more
Yes. Applicants at EUIPO can be natural and legal persons from anywhere in the world. No EU nationality or establishment is required. We handle mandates internationally – communication is in German and English.
