Why an EU trademark at EUIPO?
An EU trademark offers significant advantages over a German national trademark – not only through the considerably faster procedure, but also through the lower hurdles in the examination by the trademark and patent office.
Once registered, protection applies from the filing date. This means: anyone who files too late can no longer claim priority – even if they have been using the mark for longer.
Not only for businesses with customers, partners or distribution structures in multiple EU countries is the EU trademark almost always the first choice. Even if business activities are confined to Germany, an EU trademark can offer significant advantages due to the application process.
I've been using my trademark for years. Do I still need to register it?
Investing in advertising strengthens your brand. Trademark registration serves primarily to protect that investment. A registered trademark gives its owner the ability to take legal action against infringers and defend the mark – by filing oppositions against later trademark applications at the competent office, or by pursuing infringers directly through civil proceedings. Without registration, the options for acting against third parties are significantly limited. Moreover, failing to register a mark can result in a third party occupying the name and prohibiting its further use.
What does the trademark registration procedure look like?
Using the fast-track procedure, we typically achieve examination and filing of the trademark within a few days or weeks. After publication of the trademark application in the register, holders of earlier marks have three months to file an opposition. If no opposition is filed, the office registers the trademark. We accompany you from the first search to the certificate of registration.
